PhishGuard terms

1. The parties

PhishGuard is provided by BitTech IT ApS, Stamholmen 193F, 1. tv., 2650 Hvidovre, Denmark, CVR 37576352 ("BitTech"). These terms apply to businesses that start a trial or a subscription ("the customer"). PhishGuard is sold to businesses only.

2. Trial

The trial is free and lasts 14 days from activation. It includes the Professional features. One trial can be created per domain.

The trial does not automatically become a paid subscription. When it ends, the API key stops working. If the customer wants to continue, a subscription is agreed separately.

3. Subscription and prices

Prices are shown on phishguard.dk and are per user per month, excluding VAT. Paying a year in advance gives a 20% discount. Subscriptions are invoiced in advance.

The subscription runs until it is cancelled. It can be cancelled in writing with one month’s notice to the end of a month. With yearly billing, the subscription runs to the end of the paid period.

4. Use of the service

The API key is confidential and may only be shared with the customer’s own employees. The customer is responsible for any use of the key. BitTech may block a key in case of misuse or non-payment.

5. Verdicts are guidance

PhishGuard uses artificial intelligence to assess emails. A verdict is a recommendation and can be wrong. The customer and its employees remain responsible for how they handle an email.

6. Liability

BitTech is not liable for indirect loss, including business interruption, lost profit, loss of data or loss resulting from a security breach that PhishGuard did not detect. BitTech’s total liability is limited to the amount the customer paid for PhishGuard in the 12 months before the damage occurred.

7. Data processing

When the customer uses PhishGuard, BitTech processes personal data on the customer’s behalf. BitTech processes the data only on the customer’s instructions and to deliver the service, ensures appropriate security and uses only the sub-processors listed in the privacy policy. The customer can request a separate data processing agreement by emailing support@bittech.dk.

8. Changes

BitTech may change the terms and prices with 30 days’ notice by email. Changes do not apply to periods already paid for.

9. Governing law

The agreement is governed by Danish law. Disputes are settled at BitTech’s home venue in Denmark.
